The concept of who represents whom can be very confusing. We'll try to make it as clear as possible. There are three types of real estate agency relationships available to a buyer in Florida:

1. Non-Representative:
The real estate agency law in Florida makes a presumption of non-representation. In other words, unless you engage a real estate licensee to represent you in a real estate transaction, you are not represented and there is no agency relationship between you and that licensee.
 
2. Transaction Broker:
The real estate agency law in 1997 created the role of transaction broker. Transaction brokers provide limited representation to a buyer, seller, or both in a single real estate transaction. Transaction brokers cannot represent either buyer or seller in a fiduciary capacity.
 
3. Single Agent or Buyer's Agent:
This is the purest form of representation for buyers. Single agents have the full fiduciary duties of dealing honestly and fairly, loyalty, confidentiality, obedience, full disclosure, and accounting for all funds. Single agency is the only form of agency that creates a client-level relationship between the buyer and real estate agent.

Rather than spend your time driving through unfamiliar neighborhoods, searching for FOR SALE signs (and often being confronted with unrealistic FOR SALE BY OWNERS) or over-reaching classified ad descriptions, you want to work with someone you can trust to give you sound advice about the neighborhood and the values of homes. When the Morris team represents you in buying a home they:
 
  1. Will search in-house listings, multiple listings, open listings, For Sale By Owners, and also, properties that are currently not on the market.
  2. Will suggest the use of professionals, selected by you, to verify the quality and condition of the property, and determine whether there are any negative factors that would affect your offer.
  3. Will suggest that you give a realistic deposit.
  4. Will provide a market analysis and pricing recommendations.
  5. Will never let the seller know your motivation or top price.
  6. Will recommend the terms and structure of your offer to provide you with the best chance of getting the property you want at the price you want.
  7. Will assist in arranging financing for your purchase including acquisition, construction and/or bridge loans.
  8. Wil provide referrals for handymen, contractors, architects, movers, and interior designers.
  9. Will assist in obtaining insurance coverage.
  10. Will assist in planning your move.
  11. Will assist in establishing services such as electricity hook-ups, cable, telephone, and water service.
  12. Will disclose unpaid taxes, liens, comparable sales, other available properties, existing appraisals, seller's original purchase price, date of purchase and any other factors that will favorably influence your bargaining position.
  13. Will offer advice and consultation to assist you in making the best possible decision.
  14. Will spend the maximum time and effort to help you locate and purchase the best possible property.
  15. Will be there every step of the way to ensure the smoothest of closings and minimize the inconvenience of your move.
